Privacy Policy & Collection Notice

This policy explains — in plain English first, full detail after — what personal information we collect, why, who we give it to, who pays us for that, and the rights you have, under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

1. Who we are

This policy is issued by AM Marketing Group Pty Ltd (ABN 37 613 053 286) (“Your Crypto Guide”, “we”, “us”), the operator of yourcryptoguide.com.au. Privacy contact: privacy@yourcryptoguide.com.au.

2. What personal information we collect

  • Enquiry information — when you submit an enquiry form: your name, email address, phone number (if provided), state or territory, and the details of your enquiry (for example, the type of professional you asked to be introduced to and any qualifying answers you gave).
  • Newsletter information — your email address, if you separately opt in to our newsletter.
  • Consent records — for every form submission: a timestamp, your IP address and browser user-agent, the version identifier of the consent wording you saw, and which checkboxes you ticked. We keep these so we (and any partner you are introduced to) can demonstrate your consent was validly obtained.
  • Correspondence — emails you send to any of our addresses.
  • Technical and usage data — standard server logs and privacy-respecting site analytics (pages viewed, approximate location at city level, device type). Calculators and tools on this site run in your browser; figures you enter into them are not transmitted to us.

We do not seek to collect sensitive information (such as health or financial-hardship details) and ask that you not include it in enquiry forms or emails. We do not collect information about your crypto holdings, wallets or transactions.

3. Why we collect it — including the part we are paid for

Stated plainly, as the Australian Privacy Principles require: we collect personal information you submit through our enquiry forms for the purpose of disclosing it to up to three commercial partners relevant to your enquiry, so that those partners can contact you about it — and those partners pay us for that introduction. This is a disclosure to facilitate direct marketing by another organisation under APP 7.3, and we only make it with your express consent, collected via an unticked checkbox on the form itself that names the partner categories involved.

We also collect and use personal information to:

  • send you our newsletter, only if you separately and expressly opted in;
  • respond to your correspondence, correction reports and complaints;
  • maintain the consent records described above;
  • operate, secure and improve the website; and
  • comply with our legal obligations.

If you do not provide the information requested on an enquiry form, we cannot make the introduction you asked for; the rest of the site works without providing us any personal information.

4. Who we disclose it to

  • Introduction partners — up to three partners relevant to your enquiry, drawn from the categories disclosed on the form you submitted (for example: digital currency exchanges, licensed financial advisers or SMSF specialists, SMSF administrators, registered tax agents, crypto tax software providers). Each receives your name, contact details and enquiry information, together with a copy of your consent record.
  • Service providers — website hosting, email delivery, form processing and analytics providers, under contracts limiting use to providing services to us.
  • Regulators and law enforcement — where required or authorised by law.

We do not disclose your personal information to any other third party for their direct marketing, we do not sell lead lists, and we do not pass your details to partners who were not disclosed to you on the form you submitted.

The six-week contact window

Your consent permits the disclosed partner(s) to contact you about your enquiry by phone, email or SMS within six weeks of the date you gave it. We contractually require partners to make first contact only within that window and only about the matter you enquired about. We do not supply your details to a partner after the window has expired; if you still want an introduction later, you would need to submit a new enquiry.

For every introduction we keep a per-submission record: timestamp, IP address and user-agent, the exact consent wording version displayed, the partner categories disclosed, and the partner(s) your details were supplied to. We retain these records to demonstrate — to you, to partners and to regulators — that each disclosure was made with valid, current, specific consent, and we provide the relevant record to the receiving partner with each introduction.

Automated lead routing

We use automated, rules-based routing to decide which partner(s) receive your enquiry — based on factors such as your state, the enquiry type and partner availability. No automated decision on this site denies you a product or service or produces a comparable legal effect; routing only determines which of the disclosed partner categories contacts you. If you would like to know how a particular enquiry was routed, email privacy@yourcryptoguide.com.au.

5. Your opt-out rights — direct marketing

  • Stopping disclosure to partners (APP 7). You have an absolute right to require that we stop using or disclosing your personal information for direct marketing, including stopping any further disclosure to partners for their direct marketing. Email privacy@yourcryptoguide.com.au — no form, no fee, no justification required. We honour these requests within 30 days, and in practice usually much sooner.
  • Withdrawing consent. You can withdraw the consent you gave on an enquiry form at any time via the same address. Withdrawal stops any disclosure not yet made; where your details have already been passed to a partner, we will notify that partner of your withdrawal, and you can also opt out with them directly.
  • Newsletter unsubscribe (Spam Act 2003). Every marketing email we send contains a functional one-click unsubscribe. Unsubscribe requests are actioned within 5 business days at most, require no login or payment, and stop all marketing message types.

6. Overseas disclosure

We do not disclose personal information to overseas recipients for their own use. Our introduction partners are Australian businesses serving Australian customers. Our website hosting, analytics and email infrastructure providers may store data on servers located outside Australia (including the United States); where they do, we take the reasonable steps required by APP 8 to ensure your information is handled consistently with the Australian Privacy Principles.

7. How we hold and secure it

Personal information is held in access-controlled systems with encryption in transit and at rest, access limited to personnel who need it, and logging of access to lead records. No internet-connected system is immune from compromise; if a data breach involving your personal information is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.

8. How long we keep it

  • Enquiry details: deleted or de-identified once no longer needed for the introduction and any follow-up, and at most 24 months after submission unless a legal obligation requires longer.
  • Consent ledger records: retained for up to 7 years, because they evidence the lawfulness of disclosures already made — including after you opt out.
  • Newsletter data: until you unsubscribe, then suppressed (we keep the minimal record needed to ensure we don’t email you again).
  • Server logs and analytics: rotated on short cycles, typically 90 days or less.

9. Access and correction

You may request access to, or correction of, the personal information we hold about you by emailing privacy@yourcryptoguide.com.au. We respond within 30 days, free of charge in the ordinary case, and if we refuse a request (which the Privacy Act permits only in limited circumstances) we will tell you why and how to complain.

10. Complaints

If you believe we have mishandled your personal information, email privacy@yourcryptoguide.com.au with the details. We acknowledge privacy complaints within 5 business days and aim to resolve them within 30 days. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner: oaic.gov.au/privacy/privacy-complaints. Our general complaints process is on the contact page.

11. Cookies and analytics

We use strictly-necessary cookies for site operation and privacy-respecting analytics to understand aggregate usage. Where a partner link includes a referral tag, the partner’s own cookies and privacy policy apply once you leave our site — partner tracking is disclosed in our advertiser disclosure.

12. Changes to this policy

We update this policy when our practices or the law change, and the “last updated” date above changes with it. Material changes to how enquiry information is disclosed will be reflected in the consent wording on our forms — your existing consent is never silently broadened.

Collection Notice (APP 5)

What you’re told at the point of collection

This is the notice that applies whenever you submit an enquiry form on yourcryptoguide.com.au, summarised here in one place:

  • Who is collecting: AM Marketing Group Pty Ltd (ABN 37 613 053 286), trading as Your Crypto Guide.
  • Why: to match you with up to three partners relevant to your enquiry — for example licensed financial advisers, SMSF administrators, registered tax agents or digital currency exchanges — who pay us for this introduction, and (only if you separately opt in) to send you our newsletter.
  • Disclosure: your name, contact details and enquiry information go to the disclosed partner(s) only, with your express checkbox consent, for contact within six weeks. We record the time, your IP address and the consent wording version as evidence of that consent.
  • If you don’t provide it: we can’t make the introduction; the rest of the site remains fully usable.
  • Overseas disclosure: none — see section 6 of the policy above.
  • Your rights: access, correction, withdrawal of consent and an absolute direct-marketing opt-out via privacy@yourcryptoguide.com.au.
  • Complaints: to us first, then the OAIC — oaic.gov.au/privacy/privacy-complaints.
